Depends on the definition of hacking you're using.
Editing the WZ files or modifying the client - Nope.
Packet Editing? - Nope.
Actually breaking into someone's email, or account, unauthorized - Yes.
DOSing another user (DC flood hack) - Yes.

Most of these are interstate violations however which places them in the domain of the FBI Cyber Crimes unit, though.
Guess how much they care about little billy abusing a video game?
