TBH, I would be much more bothered by serving alongside a flaming evangelist trying to convert me, than a person of my gender trying to hit on me (or, for that matter, a person of the opposite gender trying to hit on me).
And while you're right that the social problem is deeper than the legal problem, solving the legalities is not just a coat of paint. By forcing, if you will, homophobes to serve alongside openly gay people, you give them a chance to learn that gays are not that horrible. Maybe, just maybe, they'll be cured of their homophobia and not pass it on to their children.
