They don't have to find the amendment unconstitutional; just certain interpretations.
Language changes, and modernist judges like to interpret from a modernist perspective. There's already high-profile people arguing that guns should only be in possession of officially-recognized militias. The phrase "well regulated" historically meant "highly functional"; in today's language it means "subject to many restrictions".
And let's not forget the "le muskets meme", which even [MENTION=4235]KhainiWest[/MENTION]; has repeated.
