Log onto the game and ban peopleEek I care more about the people who are messing with GMS/MSEA than those who are messing around on private servers.

About time, is all I can say. I don't understand why people defend private servers, which use content that is copyrighted and does not belong to them.

I'm fairly sure I know which PServer you people are referring to, and let me say that they still have to decrypt the WZ files in order for their PServer to function. The fact that the results are put in the MySQL database does not make the process of putting the extracted data in the MySQL database legal to begin with. It is always illegal to decrypt copyrighted material, especially when the material is being used to create the exact same work as the owner.

In essence, here's my argument:

1. The WZ files are copyrighted by Nexon and require decryption to obtain any information from them
2. Decrypting copyrighted content is illegal
3. Private servers are required to decrypt the WZ files to use on the server

THEREFORE, Private servers are illegal

It's slam dunk litigation. Pretty hard to fight your way around it, especially if you know where the server gets its information from.

Also, Devil, the OdinMS source code used the WZ files on the server.

Used to be easier, just provided a 1-lined batch file to people to connect to your server. This is now needed as Asiasoft steps up the security. But not against hackers, its against private server developers. So now the trend is to use dll files

I know this doesn't relate to this thread directly, but I'd like to say something about Nexon and possibly AsiaSoft's Terms of Service.

The Terms of Service that we're supposed to abide by is a very broken document. When most of us joined MapleStory during or soon after Beta, Nexon had a very primitive Terms of Service, since they didn't have much developed yet. However, they made it so they can change their Terms of Service at any point in time to bend whatever will they wish. For example, they changed a lot of my friends' security questions, yet they do not allow my friends to regain that information which they changed, since Nexon made it so they can edit accounts at their will. So, theoretically, you can spend $5,000,000 on Nexon Cash and be a fully legit player, yet Nexon bans you for something you have not done; i.e, false hacking ban. Therefore, you've lost a ton of money that you 'donated' to the comapny that hosts the game server that you love to play on, just so Nexon can turn around and ban you.


Moral of my post: Nexon (and possibly AsiaSoft) should REALLY look into fixing themSELVES before trying to get rid of things as miniscule as private servers, which doesn't take TOO many people from the offical game (look at Scania for instance).

While that is true, Nexon can also profit off of Private servers by suing their owners, and then claiming their copyright rewards. Don't you think they'll make better profit that way?

just thought id point this out to you from your own quote, it says it is illegal if it is similar to the original. Since PS' are basically copies (with some added stuff for some), it falls under being similar. Now, if the game was edited visually throughout, and all the characters looked like chinchillas, and the monsters were all carrots, pomegranates, pineapples and such, you may be able to argue that it is not similar to the original. So, in simple terms, if it looks like a duck, smells like a duck, but chirps like a chicken, it would be considered a poorly made duck. Or in other words, what ever the end product of the decompiling of the original brings, it mostly has to be different than the original.

The very fact that The private server actually requires the player to RUN Maplestory to connect to the server and NOT their own game makes it as stealing copyrighted material.

Doesn't matter if the server required the cilent, as long as the player CAN use it to connect to the server.
AND a Maplestory private server that runs on something does not require MapleStory copyrighted material? Tell me about it.

LOL nice excuse. Since when did they need to benefit the game? And who says there is no fun in private servers? just because one person says there is none, doesnt mean everyone says there is none. i think, they are fun (ive only played one but i still love GMS <3) and to be honest, its a lot more fun, because though it is really easy to get to lvl 200 (or even 250 for those PS's with higher lvls) there still is competition and it still gives players a chance to see what the MS world is like so they can aspire to be that good in the real server one day. Asiasoft needs to stop complaining, and focus on issues in-game.

@sniper, what clarifies "similar" and who says whether something is "similar" or not? Can snails give you 50 exp in a real version? no. Can you buy items from other servers that may not have been given in an original? No. Can you have 32k stats in an original? i think not. Do private servers usually have A LOT of glitches like the original? i think not. Do private servers normally have all the worlds that we have? No. Is it run via many networking computers? NO.

regardless, the images is the main focus of the suits at this time. The fact that it portrays the same visual sense as the original means it is illegal by that quote.

Nope. Look at how many servers are out there right now. Each one would be its own lawsuit with its own lawyers and so on. Nexon would be running a bill that it could never afford.

It targeted the main towers to try and slow them down if not stop them entirely. :X


Also, the jailtime is probably just a scare tactic. Could be a possibility, I suppose.

I'd like to point out on what you pointed out on me (Lols). It's not illegal if it's similar to the original. Private Server software is server-sided but the client is the other thing. I don't really know how to explain is what I'm trying to say is the client's purpose is to connect to the server, the server's purpose is to let the client connect. So it's two different things.

And the copyright does not cover what you present, it only covers how you present it.

Yes it does protray the same visual sense. But how? Well, the client connects to server, and sends a packet to the server. The server checks the packet, and release another packet to the client. This packet contains information on which image on the local computer to reproduce in which position. But by right, there's no modification to the client, thus the server part is very much legal.
