It was legal to begin with, but then some pro-traditional marriage people tricked the public into voting for Prop 8, which banned gay marriage. Now it's back, although the case will probably go in front of the Supreme Court. If it's stilled ruled unconstitutional, I see a big change coming for the entire country...

Finalizing how clauses and rights should be implemented in gay marriage in reference to legal matters as well as determining how financial provisions will be sorted out is an issue that belongs in the Supreme Court. It is sad that matters of overall sexual preference need to be settled by judges trained not in fields of psychology, sociology, or human sexuality but rather the law. Gay marriage will be passed by legal measures, because the belief still runs counter to mainstream social acceptance. It's just funny how things work out.

While that's great, that's not "all that needs to be done." If Hawaii overturns her unconstitutional veto, then it would become only the 7th state, along with the District of Columbia, to have passed same-sex marriage laws. 43 to go after that.

What the hell? Marijuana is one I can understand, but rape? Under no circumstance should, or will, that EVER be legal. I can't understand why people would want it to be in the first place. If you're not man enough to get someone to agree want to have sexual relations with you, then figure out a way to man up. That doesn't involve subjugating the other person.

Technically same-sex marriage is still illegal in California as the chief judge who overturned Prop 8 today allowed it to remain temporarily on the books, in the event higher courts would accept appeals and hear the case. If they don't, then it's officially overturned. Chances are it will go before the Supreme Court, which is a scary thought considering the 5-4 conservative majority vote. That being said, if it remains unconstitutional, or if the Supreme Court finds it unconstitutional, the decision will have HUGE implications across the country in setting precedence for many legal battles over same-sex marriage bans. According to the article I read about the overturn today roughly 30 states have similar laws on the books to Prop 8, meaning over half the country could see sweeping overturns if California's decision stands.

The fact that my state actually did something right makes me happy. And the judge is spectacular. He wrote a 138 page analysis of every single point. He made great statements: this situation shouldn't have even been voted on. These are rights. And rights are supposed to be protected by the Constitution.
Edit: And Takebacker, it actually umm got re-legalized...but still, yeah...

And his main contentions focused on due process and equal provisions which were constitutionally violated under Prop 8. He also said the main clauses of the law had "no rational basis," effectively saying it was an illogical law.
