Largest Maplestory hacking website being sued by Nexon America and Nexon Korea Corp.
#81
Pretty sure when it comes to the copyright laws, one of the elements they assess is 'The effect of the use upon the potential market for, or value of, the copyrighted work' aka how much money it can make.

They pretty much lost their innocence when it comes to that. The damage most of these hacks is much easier to prove, unlike something purely appreciative like fanart.

I predict this will get thrown out for Nexon blatantly lying in their case.

"Second, defendants' conduct has forced Nexon to spend enormous sums of money (and vast amounts of time) attempting to remediate the damage caused by the hacks. This includes... ...employing personnel to police the game to detect the use of hacks and 'ban' (i.e., delete the accounts of) users who are using hacks,"

BULLpomegranate!

That out of the way...

Justin Wrote:Not that I expect anything to come of this. It'll just make these sites go underground. We'll still have to deal with the same hacking bull pomegranate we always have. Just on a smaller scale, maybe.
Underground?

This isn't buying drugs online, this is buying hacks.
I think you severely overestimate the caution of the clientele of these sites.

CarrionCrow Wrote:It is not like they could possibly win against Nexon in court either. Nexon could just roll over on them with their vast funds and bury the site owners for the rest of thier days.
At the very least, Nexon could drag it out so all the money that these people have made gets burned on court fees.

I say they'll win though. The precedent has been set.

CrazyNomad Wrote:Nexon need to fix the game before trying to blame other for every pomegranate that happen on maple.
This is Nexon fixing their game.

Without a complete overhaul, there's no way to completely prevent hacks in their game.
Even then, they'd still exist.
No game is unhackable.

KhainiWest Wrote:They are essentially setting an example using that website which will make players much less likely to attempt to distribute hacks as consequences are involved lol. That will at least flush out some number of people.
Fixed.

Suing individuals for hacking is a losing battle.
The intent of this is to stop those who know how to do it from allowing others to do it.

KhainiWest Wrote:I think the bigger problem would be, although they end the saga, there will be leftovers, and those leftovers will run the server.
Until they're hit hard with the hammer which will be much easier to do with all the rabble cleared out.

Jerry-Boyle Wrote:Would this attract Anonymous toward Nexon?
Is this a real question?

happylight Wrote:Nexon should NOT win this. Writing software that works in conjunction with other software should not be construed as copyright infringement. As much as I hate hacks on Maple, stuff like this is why we are against SOPA (trying to take down websites for poor reasons).
Ugh. You people...

They are not being sued because they're writing the software.
They are being sued because they're selling and distributing the software.

Get that through your skull, please.
This has absolutely no connection to SOPA, but thanks for trying to show that you pay attention to the hot topics, even when completely irrelevant.

Just to clarify that I wasn't suggesting every hacker be hunted down and be prosecuted, that is ridiculous lol. My point was, for both posts, that even though this may take out a big head of the snake, unless they follow up on it in game, the damage is already done. Also the fear factor becomes a huge part of this as not only the distributors but the users might even become hesistant to risk this.

They are invisible! They are always there, always watching.

loljoke.

But seriously, this is a good start for stopping hacking in the game. Less hacking = More players = more money = more time = better content

happylight Wrote:Exactly. Big corporation trying to squash the little guy's freedom of speech.

happylight Wrote:It is in their best interest but this is not the way to do it. No laws have been broken. If I wrote a software that improved the speed of Windows by 1000% and made a lot of money from it, should Microsoft be able to sue me? Nexon should not be able to dictate what software people run on their computer in conjunction with their software except by refusing service (banning). Just like Microsoft cannot tell me what software I choose to run on Windows. To do so WOULD be anticompetitive.

happylight Wrote:Er no. If that's true then Microsoft would be able to sue anyone who writes software that runs on Windows.

After reading all your posts together, I truly hope the hackers hire you as their defense attorney because Nexon would win in a landslide.
Also in the future, I hope you will not try to interpret what can and cannot be done in the court of law because it is a waste of other people's time trying to respond to your ridiculous understanding of the civil court system.

That awkward moment where a 14 yr old tries to pretend they know the court system when in reality they are just nervous they'll never be able to acquire their public hacks again.

Don't you think that sort of accusing is going a little far?

I think happylight has gotten the point by now >_>

People generally do not change opinions that strong that quickly, but it is still beating a dead horse, yes. If they haven't seen their error yet, they won't, so it's a waste of time to continue bashing them, just adds fuel to the fire.

Nexon has a decent chance with this one if they follow through and are as aggressive about it as they sound (and as they should be). They will get a much better lawyer at the very least, and while I generally would not support "Johnnie Cochran"ing some poor losers, there are always exceptions to the rule, and this is one of them. They have been screwing with this game for too long, they need to be dealt with as harshly as possible to scare the pomegranate out of anyone else that even thinks of trying to take their place.

Calling them a 14 yr old and the court system thing? Yes. Throwing out the idea that people who are trying to say Nexon has no grounds to do this are ones who use the hacks and are afraid that they won't be able to play the game effectively without them if this does succeed? No.

Though I'm sure happylight is none of these things, given the state of the game and with the recent familiar hack incident where a lot of "legits" showed their true colors...can you really blame me for thinking something like that?

WTP is a Nexon and why should we care about a story about maple syrup?

In general, not being able to worry too much about hacks helps the company devote time and resources into... actually improving the game for once. *gasp*

Of course, outsourcing security could work too. Except it hasn't as Hackshield hasn't really stopped anything.
