From an ECA e-mail just gotten a few seconds ago:
Quote:Just moments ago, the Supreme Court in a 7 to 2 decision, has decided that, like music, books and movies, video games are First Amendment protected speech in the case Brown v. EMA. So many people took action signing the gamer petition and directly filing briefs with the Court.
The decision has been a long time coming, and we're so pleased by today's news. We're sure this isn't the end of the fight. One decision doesn't mean that we won't see elected officials attempted to test these new parameters. You better believe the ECA will continue to fight for the rights of the entertainment consumers and we hope you'll stand with us and add your voice.
But today, we can hold our heads up a little higher knowing that we won this fight. We'll be following up later in greater detail once we've read the complete decision.
Happy gaming,
The Entertainment Consumers Association (ECA)
And here's the official statement of the ruling: http://www.supremecourt.gov/opinions/10pdf/08-1448.pdf
Quote:Respondents, representing the video-game and software industries, filed a pre-enforcement challenge to a California law that restricts the sale or rental of violent video games to minors. The Federal District Court concluded that the Act violated the First Amendment and permanently enjoined its enforcement. The Ninth Circuit affirmed.

Well it's certainly not the state's job.
If the parents don't want to monitor what games their kids are playing, USE CONDOMS.

I grew up on violent vidya like Mortal Kombat, Doom, and Duke 3D. Look how I turned out!
Nothing rustles my jimmies more than old people blaming violence on video games. Glad this happened.

And in a surprising twist (not really), California Senator Leland Yee still wants to fight!
Quote:"Unfortunately, the majority of the Supreme Court once again put the interests of corporate America before the interests of our children," he whined. "As a result of their decision, Wal-Mart and the video game industry will continue to make billions of dollars at the expense of our kids mental health and the safety of our community. It is simply wrong that the video game industry can be allowed to put their profit margins over the rights of parents and the well-being of children."
In addition, Yee has tried to take credit for "forcing" the industry to be stricter in its self-regulation with his eight-year waste of time and money, and makes it clear that he's not done yet.
It's estimated that $1 million have already been spent trying to make this law work - from implementation to all of those legal fees through countless court battles. Lul he's putting California in deeper dept.

Honestly all a parent has to do is read the case/box of the game and they can determine if their child should play it. About the only thing this bill will do is limit the industry itself, and considering it's an industry built on creativity, that's REALLY bad.

But.... Nintendo doesn't allow "really violent" games unto their consoles.

I probably should have also mentioned the CoD ports to the Wii too, but they're not worth mentioning.
But back on topic, it doesn't seem likely that things are over. Looking over the judgements closely, there were two judges who agreed about the idea of restricting minor's abilities to buy M-rated games. They even believe that games seem to have more of an effect on people than other mediums (books, movies). Probably by that alone will Yee feed off of and still fight. :/
EDIT: Guys, I was kidding about Nintendo here. Of course we all know that Mario can be one violent communist.

Mario = Crush and burn small animals
Kirby = Inhale and consume the bodies of living creatures for strength
Samus = Destroys Aliens with guns for money (Is " bounty hunter" still part of her persona now?)
Legend of Zelda = Eviscerate animals and sometimes humans with swords, arrows, bombs, and a variety of dangerous weapons
Pokemon = Enslave small animals to fight each other for money and bragging rights
You where saying?

Not even that. If your 5 year old wants a game that clearly has a half naked woman on the front cover, it would be normal for a parent to just LOOK AT THE GODDAMN COVER and say no, but parents blame the industry instead because they don't give fair warning...
