I could have sworn they had odinms.exe on their site. Maybe it was just a link to a file sharing site, like mediafire. Does that make a difference?

I think they should (or are)su(e)(ing) for stealing the concept of maplestory instead of the .exe. But, I wasn't really following this so don't take my word on it.

The most common hacked exe was one you could point at any IP anyway, so the player could really get it from anywhere.

Problem is that they can't sue OdinMS for copying content, it's not the idea of MapleStory they ripped off, it's the code of the MapleStory client and the server code they used based on this game.

If copying ideas was a plausible means of sueing someone, games as we know them today wouldn't even exist. Hell, MMORPGs are all based around the same concept.

Exactly, Nexon is just wasting their money, do you see Gravity(RO online distributor) sueing private servers? NO!! because they know its useless, oh well

I guarantee Nexon wins this, You all can remember I said that and I will be more then willing to eat crow if I am wrong. My belief in this is based on First LCC vs Tim McArthur. (Side note: First LCC is now "i Racing" if any of you are nascar fans you may know this name as the name often apperas on a Roush Fenway car. Side note 2: The person attempting to sue Tim was, John Henery, owner of the Boston Red Socks, co owner of Roush Fenyway Racing as well as primary owner of "i Racing") The only reason Tim did not lose this case is because he distributed a tool to modify the games exe, he did not repack the exe and re-distribute. This is one of the very first cases tried under the digital millenium act. Had Odin released a "tool" that would change Maple story to Odin story, rather large task I know, they would more then likely be in the clear. It does not matter if they codded odin themselves, that is why "likeness" is protected. If coding it themselves was the case, what would prevent them from "selling" this self coded content? How would any game company make money if self coding would allow you to bypass copyright/ intellectual property laws. Just like Chevy couldn't make an exact copy of a Ford Mustand and call it the Chevy Horse.

This isn't meant as a debate, just my personal view on things. I know this subject can get very heated and that is not what I am attempting to do at all.

I was under the impression suing someone was to recover lost profits. How can Nexon quantify lost profits for a free to play game?

Potential loss is a viable case as well. As in the case I mentioned, the game that was being "sued" over was Nascar Racing 2003 made by Papyrus Games. Papyrus lost the "rights" to the Nascar name as Nascar granted EA sport the sole "rights" to use the name and the company went "under" as all they did was create Nascar simulations for the computer. " iRacing" First LCC at the time, who bought the game engine from Papyrus had absolutely no intention of using the game engine for anything other then testing. Their claim was, if this can be modified and distributed freely, why would anyone buy the product we intend to make? Had Tim redistributed any of the game content self created or not he would of loss. They also filed cases against many modding teams though they all submitted to the cease and desist order and no further action was taken.
As for the free to play, I"m sure they can take a user base divided by profit to come up with an average amount a player spends on the game

Sueing isn't just for loss profits, its also for patent/copyright/trademark infringement, among other things.

No, seriously? You need evidence to prove they were running a carbon copy of maplestory, using all the maplestory images and music, at the very least, regardless if they stole the rest of the code, is enough to get them in serious pomegranate.

2 years of gathering evidence for a low resolution 2d pixel mmo with the technology system of an average late 90's game, which crashes if you run it on WinVista/Win7 when you try to fight squad bosses? Welcome to the year 2010! Smile

It's almost the same as sueing people for posting the quake3 source code... oh wait... that once is license free already because it's frickin ancient already, and the company that made it (Id Software) is already 20 years ahead of the code they made in 1999... and since they know that themselves, they decided to publish it for the community to play around with.

It's not some kind of serial killer or air-crash trial... this simple evidence should have been gotten within 1~2 months max...

If you can't gather evidence for "such -severe- copyright infringement" (which it is, according to Nexon...) in less then 2 years, then Nexon themselves almost admits publicly that they never had anything to start with.

^well done on not touching my point at all. Neither of us know how legal proceedings work, you can't say OH BUT IT CAN'T TAKE 2 YEARS, without proving it, especially since a lot of course cases take years. OF COURSE murder trials are worked harder on, they're much more serious and problematic if you let someone be accused of murder, if they're innocent or not, so they are given a lot more priority.

I don't actually think they're doing this particular lawsuit for money, they are probably using it as a resources to cite cases....

1. Find a PS

2.Bring them to court

3.Cite Nexon V Odin

4. ????

5. Auto win?!?

also I don't think Germany has the right of "Freedom of the press"... and "most" cases can take months if not years for something to be done...

->That's the main question here... did they really do that and who -exactly- did that then? It was never on their site / forum. Nexon has to -prove- it was distributed by the guys from Odin with -hard- evidence. And -that- IS going to be a very hard case to crack, if not impossible...
-> The OdinMS servers were raided. Nexon has access to all of the files the day the site was taken down

OdinMS ran its own PServer
-> Running own written server software is not illegal, as long as the server software itself is not copied from another source.

didnt OdinMS sell some sort of nx or w/e?? if so then nexon has a case otherwise they are wasting their time and probably just using this to scare other Private servers.

I know you're kidding, but as an FYI since we don't "technically" pay for "good" customer support so we can't exactly do anything... we could sue the hackers though
