What Going Happend To OdinMS ?

Update (02/03/09): Please take note of the following statements signed by us, Patrick Huy and Matthias Butz. As you can see we currently cannot accept all of the demands. Nevertheless we are still more than willing to settle this dispute peacefully out of court.
Basically the content of the statement is that we agree under contractual penalty not to be involved in any private server activity concerning Nexon's property.
We would also like to take this opportunity to ask you to stop any such activity you may be involved in for your own good. It was never the intention of OdinMS to do any harm to Nexon, so be aware that running private servers is not at all in our interest. Far from it! If you want to show your support you can find the means to do so below.

for me,i seriously think odinms deserve a chance,being a corporations it is not about power,when odinms came out in 25 december 2007,nexon did not do anything at all only after 7 months later they filed a lawsuit.why? and besides nor did odinms devs forced people to leave gms for thier server nor did they replace anystuff.

odinms devs used the server to control the client if you know what i am talking about see Client folder for more information.

i mean like come on every game have private server sooner or later it would have pop-up.

I love how everyone suggests this yet it would be a conflict of interests for nexon to do so

think about it this way you own a store, someone shop lifts you, they get caught, you hire them to work in your store... sound like a good idea to you?

at any rate Nexon had to show it meant business when it came to pservers odinms was basically the example for the community to see what happens when you screw with nexon...

Would I like to see OdinMS stay up? Sure, Its of little consequence to me.

But if I was in Nexon's shoes, i'd have done the exact same thing they're doing from a buisness standpoint.

Theres already a billion threads and debates just like this, so im not going to go on about it aside from once again saying that anyone in Nexon's shoes would take the same action if private servers significantly diminished sales for them.

Whether they're in the right to do it or not, I dont know, and I wont pretend I do, Intellectual Property law comes into play, but so long as the servers remained free theres apparently a loophole there, who knows.

About the "private servers don't take away players from Nexon"...... that's complete crap. We all know private servers take away players from Nexon. Will those players 100% spend NX? Can't say for sure, but it's obvious that private servers do take away players from the real server.

As far as I can see now, Nexon has sent a letter to them with conditions under which Nexon agrees to settle the case, and the Odin people have sent this letter back to Nexon in reply. They state they don't agree with all conditions Nexon states (blackened text).

I guess they want to settle so they can go on with their lives and Nexon drops their case against them.

That's all, nothing more, nothing less... It happens all the time in the legal world...

Also, I see in the letter, the main complaint from Nexon is about the OdinMS.exe file, not the servercode itself. Nexon asks them to ceise using the OdinMS.exe -CLIENT- file (the hex editted maplestory.exe file to adjust the server IP adress) to connect to their home made server.

So, Nexon's main focus is Odin's hex editted OdinMS.exe, not the home made server software itself...

Wasn't there a Ragnarok Online case a while back that went the same way like this one? And there are so so many Ragnarok Online servers up right now because the creators of Ragnarok online lost in the courts to the private servers.

This is Nexon's game, they OWN the images every private server is using, so they're within full legal AND ethical rights to shut the damn things down.

Someone here said this argument is beating a dead horse. I agree, because this horse is not just dead, it decomposed months ago. Devil for example is making an argument that was THOROUGHLY refuted as logically fallacious and legally untenable by myself and Afrobean, (among other people.) Fiel finally locked that thread and outlined the terms for interpreting IP via a series of links. The thread is right here:

I have 0 love for Nexon, (look at my avatar for fuuuck's sake,) but Odin MS was pure IP theft, they have been rightfully shut down, they and their imitators have no case in law. Private servers use Nexon's IP and have no legal right to exist unless they have gotten legal permission from the owner of the IP, that is Nexon. If you want to fight Nexon, you should patronize its competitors. That is what I have been doing since they screwed over Fiel. However, trying to take their ideas under the table will get you hit with a lawsuit, and you will deserve it.
