'everyone else does it so they should be sued too' - that's what it comes down to when both sides are to blame.
I think a better defense would be "this is ultimately a victimless crime" - case dismissed. (Haven't read the entire thing so dunno if that little defense was used).
And now we know why it only took a few years for a broken system like the MTS to go away. I'm almost certain it won't be back.
