Devil, could you show me where the checkbox is? I'm not sure which one you're referring to, and I'm not sure if I've already unchecked it. ):
It should be the one on the cutting tool / lasso tool menu that shows when you select the tool (in the top of Photoshop, depending on the version you're using).

But yeah, the chance that you have disabled that one already is large.
