As a customer, I am not required to sympathize with whatever hardships they are facing due to their own incompetence or cheapness or both.
I expect the service to be available whenever not announced to be down ("scheduled maintenance") or curtailed by circumstances out of their control (power out).
If they mess up and it's down more than that, they should compensate, in-game. I'm not asking for real-life money or objects. Just virtual compensation for a virtual loss. 2x, maple points, mesos, game items (cash shop or normal), etc.
And as their customer, they aren't require to do sh'it for you. Look at your bold, then look at the following:
nexon terms of service (which you agreed to) Wrote:THE SERVICE (INCLUDING THE SITE, THE GAMES, THE CASH ITEMS, THE SOFTWARE AND ALL OTHER CONTENT CONTAINED THEREIN) AND ANY PRODUCT OR SERVICE OBTAINED THROUGH THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

.
THE COMPANY AND ITS AFFILIATES, LICENSORS, SUPPLIERS, ADVERTISERS, SPONSORS, PARTNERS AND AGENTS DO NOT WARRANT THAT YOUR USE OF THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE, AND THE SERVER(S), SYSTEM(S) AND NETWORK(S) ON WHICH THE SERVICE IS HOSTED AND/OR OPERATES, ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
You agreed to the terms of service in order to play. Thus you agreed that they aren't under any obligation to do squat for you if the game isn't available, whether or not it was them that took it down... with or without notice.
