The difference is in causation.
When the seller screws up, the buyer didn't contribute to it in any way. The seller did it all by himself. The buyer may have taken advantage, but he did not scam. He did not trip the seller up. If this particular buyer didn't buy, someone else would, because the item is already up there for sale for the too-low price. (The saintly thing to do would be to buy the item and then sell it back to the seller at the same price, but few people would actually do that).
When the buyer screws up, the seller does all he can to trip him up. It's the seller who puts up an item that looks like another, at a price that resembles that of the other, and sometimes even mislabels their shop (I remember shops that actually said "attack glove" and sold those nub claws) in order to cause hasty buyers to make a mistake. Yes, the buyers *should* have read the description, but if you want to go that way, there are no scams whatsoever in Maple. It's all just stupid people who should have been more careful.
