I wouldn't say it's a clone, but it's definitely an offspring. Definitely too heavily inspired. It's really just stylized with a few new blocks/mechanics. It's legal, but it doesn't mean it won't be discriminated for originality.
What does the development process have to do with it being a Minecraft clone? It simply has to do with how the idea evolved. This guy obviously had enough ammunition from minecraft to stock his game with.
Notch had infinite water at one time. It'd flood everything lower than the source. Now, it's in between infinite and finite. Really just has to do with 3d vs 2d.
It looks cute, but I probably won't consider buying it unless it has many more RPG-esque elements, as the art-style would point to.
