Okay that's one article. You have a point in that perhaps she did intentionally throw herself down the flight of stairs.

I don't think she threw herself down the stairs intentionally. I think she is innocent of the charge. I'm not making that point. What i am saying is that she raised suspicions amongst the staff and i think the staff acted on those suspicions properly. The staff didn't go "hey cops this woman thought about abortion earlier in her pregnancy arrest her!!1!" It was something more along the lines of "We think this woman may have attempted feticide." It ended up not mattering due to the age of the fetus, but i think she would not have been prosecuted anyway.

How about the woman who was held in the hospital against her wishes?

Or from the alternate perspective was ordered bed-rest by her doctor due to the baby being in severe risk of miscarriage and her basically just responding 'lolno' When your doctor orders something like that and you basically just say i'm not going to do it, you don't put the doctor in an easy position. The fact that she miscarried only three days later only shows her case was pretty severe.

Besides i think i made a clear demonstration of how pomegranatety the first article was to have to go hunting for the really far-fetched sources that may accompany the second.

The bottom line is, she (Burton) was fully intending to carry that child to term. And by other sources she didn't ask for a referral politely, as the article may put on, but resisted the possibility of bed rest (and possibly as well as quitting smoking as well, but that's my personal speculation) forcefully.

One of the more interesting things i found is this excerpt from a body of quotes from her appeal lawyer (not a court appointed lawyer if that makes a difference to any of you).

"The court order was so broad it was one of civil commitment," he said. "It basically said any treatment deemed necessary to respect the fetal health and made her a ward of her doctor."

"This was not refusal of medical care, it was about who decides and in what setting," he said. "When I walked into her hospital room I saw no monitor, she was alone in a bland room, not unlike a prison cell, not the kind of place you'd want to spend three months alone in separated from your family."

The state has argued that the court order was necessary because the medical well-being of the fetus was at stake. Burton, they say, had also refused to stop smoking.

It seems like he's not making a case for a repeal of the law or anything. But wanting limits on how broad these court orders for hospitals can be. Seems fair. Oh it should be noted she's not seeking financial restitution. My thought is that is with the advice of one or two of her lawyers. She wouldn't get it and it would just hurt the second half of the case.
