Energy bending was a decent cop out. to make a "young" person make the choice of kill or be killed would have been a little fucked up for a 10+ kids show. The energy bending also shows that even the Avatar, the greatest bender in the world, could be overcome with grief and conflict within themselves. It shows that though they posses god-like powers, they are still human.
A regular person yes. A person whoms suppose to protect the world and since like the second season has had to conteplate just how he was going to defete him without killing him... no. For a show so well known for its writting and chracter development it seems cheap to give him a deus ex machina abilty at the very last second. Seriously if it were introduced in season 2 (I'm not counting the lion turtle showing up in the book because that just showed the turtle, it said nothing about energy bending) or at least hinted at in season 3 i wouldn't have considered it a cop out but really it wouldn't have shown him as a betrayer of his beleifs if he killed Ozai, it would have shown that as the avatar he was willing to do what was right for the world at the cost for his beleifs.
