Punishment is often inconsistent. Are all muggers, robbers, rapists etc. in jail? Just like it's impossible to catch all offenders in real life it is hard to catch everyone that makes a bannable offense in maple. However, that doesn't make the punishment to the ones caught invalid, it's better to punish some than punish none.
