The theft of that is a tangible cyber crime.

Previous case law has supported that stealing virtual goods is itself a crime depending on the laws of individual states. This is even less ambiguous because it wasn't even a virtual good, it was actual credit.

On an interesting note, if this came to court, it would be a matter of both sides having to prove they weren't responsible for the breach. If a user testifies, under penalty of perjury, that no one else was aware of their password or PIN, had ever had their password or PIN shared, had ever written down their password or PIN, and that they themselves are not responsible for the unauthorized access to their account, it becomes incumbent on the company to prove that their security hadn't been bypassed.

Personally, I'm investigating a court order of my account logs for the day of my hacking because I have a static IP - Intrusion into my account is clear as day. I want to see if this hacker actually authenticated to the login servers using my information, or if that IP authenticated as one user/pass then the game server transferred them to my account. If they actually had my user/pass they would've had to authenticate and have a clear trail, if they used some form of Packet Editing to swap into me, the login server and the game server will have a different rendition of events. The latter scenario is clearly an attack Nexon is responsible for patching and refunding. The former leads us back to the question of "how did they get my account info" and Nexon providing proof that they were not negligent with my personal information.
