It's only 3rd party software if it affects the game in some form. For example, a program that lets you jumpshot is an unfair advantage because you're not using it manually. They used to consider windows mode like that, but the only person I know who got banned due to windows mode has been unbanned for months. Fraps just takes footage, it doesn't affect gameplay. They won't ban for it any more than they will for taking a ss.
