I would like to think a 16 year old "babysitter" would have enough common sense to not do anything dealing with a young child head. The "I used a pillow" is a poor excuse at best but it really isn't an excuse at all. Also punishing a child that isn't yours in such a way is only asking for trouble regardless of age of the child. Everything about this is just stupid.
I say let him rot. Sound like a psychopath to me if he hit the child hard or enough times to the point where he was hurt badly enough to die from it.
