But by your logic, luffy, would not be rubber when he's asleep which is not true. Or when Lucci was finally beaten he didn't revert to his form, while kaku did.

Or the gnomes overheard don flamingo explaining why she can't sleep while shes whining, possibly be the reason she eats grape, we won't know until it's explained to us, and OP's pretty consistent on that regard.

Luffy and most other devil fruits don't stop working when they're not conscious. We've known that forever, say, since when luffy was drowning in the arlong arc after he was tossed in the water, couldn't move or breath by himself even after they stretched his head above water (proving both that his fruit still worked and that he was unconscious).
