Tons of shi'tty "simple" games are made and released every day on mobile platforms. If it was anything other than dumb luck, it wouldn't have happened randomly over 9 months after he released the game.
Indie devs shouldn't sell out and start making complete turds just to "get a clue" in the vain hope that they can be the one of a hundred pomegranatety games released any given week that maybe one a month catches on for no discernible reason. (And then gets 20 clones of its own in a couple of days)

Are you kidding? Nintendo makes people take down stuff infringing them publicly fairly often.
