Yep, it was implemented with the Legendary rank, you can see their level requirements in this thread: http://www.southperry.net/showthread.php?t=47311
If you already have those potentials on lower leveled equips from before they added the level requirement, the game won't take it away from you, but if you cube it away, it's gone for good as it is no longer possible to get those potentials equips that don't meet the level requirement.
