I recently came back and have a question on how they work. With the positive chaos scrolls coming in around 2 weeks i read from other sources that the hammers if they fail will take up a hammer slot is this still the case?

Yes a failed hammer counts as losing the slot, but you can use clean slates to get it back.

In case you are wondering, If you use a hammer then innocent you lose the hammer upgrade (whether it failed or not). If you fail a hammer you have to clean slate to get the slot back like mentioned, you can not innocent.
