OdinMS was never leaked, iirc, just stolen by LocalMS. They had always planned to release it, and when they felt that it was stable enough to be released, they released it.

didnt OdinMS sell some sort of nx or w/e?? if so then nexon has a case otherwise they are wasting their time and probably just using this to scare other Private servers.

No, they didn't sell NX. You're thinking of LocalMS, which was run by the ex hoster of Odin. Odin never gave any benefits whatsoever to those who donated, not even on the forums.

2 years of gathering evidence for a low resolution 2d pixel mmo with the technology system of an average late 90's game, which crashes if you run it on WinVista/Win7 when you try to fight squad bosses? Welcome to the year 2010!

It's almost the same as sueing people for posting the quake3 source code... oh wait... that once is license free already because it's frickin ancient already, and the company that made it (Id Software) is already 20 years ahead of the code they made in 1999... and since they know that themselves, they decided to publish it for the community to play around with.

It's not some kind of serial killer or air-crash trial... this simple evidence should have been gotten within 1~2 months max...

If you can't gather evidence for "such -severe- copyright infringement" (which it is, according to Nexon...) in less then 2 years, then Nexon themselves almost admits publicly that they never had anything to start with.

Let me enlighten you with some information. 2 years in not really a lot to get a trial running. There are pretty controversial trials that stay in the ''gathering evidence'' and ''nominating suspects'' phase for years and years. There's a case in my country, for example, that hasn't been solved after 12 years. They are still in the trial phase, and they can't come to a sentence.

If I recall correctly, this case is in Germany jurisprudence jurisdiction right? If that's so, the system they're using is not anything like the American system. Let me explain, the case won't be based on precedents, the case will gather evidence and will be sentenced according to the judge's criteria. An attorney can try to revoke the sentence, lessening the paycheck the OdinMS guys are gonna get. It's pretty obvious Nexon doesn't want just recognizement, they want a refund.

Again, the process can last for years, and the case folder will only grow and you can see no sentence whatsoever.

I'm from the Netherlands, living 20km's away from the German border, I know the laws systems are different. I also did 1 year European Law at University, so I also know that the German law system is really slow the way its designed (there's a reason for it though...), compared to other legal systems in the world.

But a law system can be slow, an a proces make take several years, but what I'm surprised about is that the evidence gathering takes so long. They people from OdinMS have the right to see any form of evidence presented to them, where they are accused of by the other party, and normally that's bound to time limits... Now I don't know how long those limits are in Germany, but I hardly doubt it's more then 2 years...

Well they did seriously brake a law, and I may not agree with the lawsuit but they are entirely deserving. Besides this is a smart move by Nexon, if this lawsuit actually ends in their favor, goodbye 500+ pservers the next morning. The majority will close in fear and the rest will be weeded out by threat of lawsuit. Makes sense
