The $100000 one doesn't really matter because there's no real proof that a host of a private server or hacking website actually agreed to the terms of service in the first place. The $1000 one for hacking though... it would be funny if they tracked people down and demanded a thousand dollars.

I dont think its feasible to hunt every hacker and make them pay 1k Usd, the cost of finding and prosecuting each and one of them >> 1k USD IMO, besides a lot of them are outside the US were the laws wouldn't allow it.

Well not quite. The above ^ issues a consequence to a person only as they are becoming aware of the fact that they are doing something which would merit a consequence. The ToS on the other hand lets you know ahead of time that if you're doing something illegal (in there terms)there will be consequences; they also allow you to not accept their terms and not play their game. So you are perfectly capable of avoiding a situation in which you would be fined. In fact, its quite easy to follow the specifications they gave.


Of course this only applies to anyone who has actually hit the "OK" button on the ToS. If anyone from any given site that does things against this new ToS hasn't pressed that OK button, they aren't bound by that ToS. They'd have to have the ToS appear as a precursor to downloading the game itself or perhaps during a patch to ensure that anyone who wants to use the files will have to agree to the ToS.

Penal damages are not legally enforceable, it's only there to scare people and any attempt at using it in a court would simply result in it being declared invalid and unenforceable.

A contract may specify liquidated damages for breaching that contract, but those damages must be within the realm of reasonability for actual damage the breach has caused. You can't insert a clause like that to "punish" someone for breaking the contract, only to recoup damages directly caused by thier breach.

Nexon actually royally screws themselves on their free to play motto here - because if it's free to play MapleStory, how can you can be causing them a loss when there is no monitary expectation expressed in your usage of the service? Unless you were doing something that demonstrably impugned upon thier image, violated their intelectual property, or interrupted their service and therefore it's potential to make money they can't sue you for breaching their ToS because you're not taking any actions that cost them money for them to seek to recover.

The only items I can think of off hand that qualify in the latter criteria there are Denial Of Service attacks, NX Fraud, and possibly widescale disconnect hacks. Running a private server would be illegal because it violates their intelectual property, reverse engineering their proprietary formats wouldn't be illegal in and of itself, nor would packet sniffing them to find out what they're communicating to your machine, or in memory disassembly/debugging to see what their application is doing.
All those are legal and can not directly hurt their profitibility unless you then use the information gained from any of those actions to directly compete with, or hinder, thier operations. Packet Editing would be tampering with transmissions and is subject to local legal rulings.

Also, I should clarify that accessing a private server could not result in suit for damages, only actually running one. This is comparable to a person patronizing a bar that hasn't paid for a performance license for the music it's playing. The bar is culpable for damages because they're not legally entitled to play the music without having licensed it from the recording industry, but the patrons can not also be fined for having heard the music. This is also similar to the legality of downloading pirated music vs distributing pirated music. It's unethical to do so, since it's contributing to an abuse of intellectual property, but the actual crime is making it available, not using it.

Besides that any ToS in a foreign language (with several words I don't even know what they mean without looking them up) together with that ToS beiing presented in such a crappy way like this one (I clicked on accept the first time without reading), don't apply to Dutch citizens (there have been several processes here about this already and -all- failed on how they presented their ToS, or not understandable language, even in dutch itself). Nexon makes the classic fault that you can't send a binding contract in such a way.

Let's say, I send my own ToS towards Nexon (yeah you know their auto reply bot), and state "By replying on this message Nexon America agrees to pay $ 1.000.000.000,- dollars to me". Offcourse I will get a reply (from some GMBot). However I can't go to court and collect my cash... It's just not how the legal system works...

So yeah, this is just pure bullcrap... It's just another Nexon failboat...

Also, they're stating that they want people paying 1000 dollar for playing at private servers? ROFL What happened to the free game Nexon? Or are you stating that playing Maplestory actually costs 1000 dollars per person to play, and if you don't pay you smack your players in the face? Lol... Failboat nr.2....

The sad thing is that Nexon America is turning more and more, patch after patch, into a simple online casino coverup. Instead of publicly hosting an online gambling website (which is illegal in the USA), they infuse thier "free game" with such a lot of gambling stuff (gachapon, iTCG codes, etc), and encourage kids to start gambling, that in the end, Maplestory has been nothing more then a big visit to a casino, while playing a "free" videogame... And yeah, offcourse the addicts and Nexon themselves claim "You always win something, it's not gambling!". Yet a LOT of people "invest" several hundred dollar per month on buying virtual gambling tickets to aquire money with gambling for good items... It's so hypocritical...

Maplestory... the free online casino, where everthing costs a shietload of money and everyone has to goddamn pay, or Nexon America will sue you and tells you to GTFO and die... :')

Well to the people who think it's not enforceable...... I really don't think that Nexon just thought up a ToS and wrote it up out of their ass without knowing if it would be enforceable or not. With a company like that, they definitely had lawyers with them to make sure the contract was a binding one. One that they could act on.

You are not allowed to enforce everything you put in a contract. the only thing they can use this part to is to sue private servers and hackers for damages caused by them. the problem is that the financial damage caused by hackers divided by the number of hackers causing it is extremely low.

You know what Nexon is gonna say to that? Look at every single fansite, forum, and their own forum. Look at how many people complain about/have quit because of hackers. Hackers DO CAUSE financial damages by causing people to quit MS. I know PLENTY PLENTY PLENTY of people who quit because of the hacking situation. Private servers are no different....... I always heard "ohh Nexon can't do anything about PS's, they're not harming Nexon, blah blah blah"...... well look what happened? It's only going to take 1 or 2 people to hack, Nexon will sue them to make an example out of them, and they will post who they are and what happened. Then everyone is going to talk about it, and hackers will be scared to hack.

Like I said, Nexon didn't just write this up out of their ass. They had lawyers to make sure everything was legit and enforceable. Hell, if they need someone to testify that they quit because of hackers in maple, i'll be more than happy to send over a few names.

ofcourse, but how big is this financial damage, in one year? lets exaggerate and say $500,000 (its much, much less). how many hackers, glitchers, and meso sellers (im ignoring private servers here, since we know that they CAN and DID sue some for the damage caused) are responsible to this damage each year? at least 300,000. so lets say, yesterday nexon caught all 2008's hackers and sued them for all 2008's damages. every one will pay about $1. now do you see why its BS?

You can't prove in exact dollar amounts how much damage hackers have caused. If they go after someone who was the designer/distributor of a hack then they have more leg room to get as much money as they can, but that's not why they would sue someone. They're not trying to get rich off of suing a 16 year old; they're only suing him as an example to keep others from doing it.

Say that you're right, and they were caused $500,000 in total damages. That $100,000 is well within the $500,000 range. They can tie one distributor and say "you gave out hacks to thousands of people, and thus caused us a huge financial loss". That's all it's going to take.

the people using the hacks are responsible to the damage not less than those supplying the hacks, just like a murderer is responsible to his crimes more than those who supplied him weapons.
